HEATHERRIDGE UMBRELLA ASSOCIATION
1. ABANDONED VEHICLES – Any vehicle which is partially dismantled, non-operating, wrecked, junked or has been left for such time, or under such circumstances as to cause such vehicle reasonably to appear to have been abandoned. A vehicle having expired state license tags. 2. APPROVED VEHICLES – An approved vehicle shall include any conventional passenger vehicle or small pick-up truck, which is used for personal transportation, of such a size that it takes up no more than one parking place. The vehicle must display current state registration. 3. AUTHORIZED HEATHERRIDGE RESIDENT – An individual who resides in a dwelling unit at HeatherRidge and who is either the owner, a cohabitant, a tenant, a contract purchaser of a dwelling unit, or a member of the immediate family residing within a particular dwelling unit of any such owner, tenant or contract purchaser, to whom a valid key card has been issued. 4. COMMON PARKING AREA – Any designated parking area separate from the roadway. 5. ENFORCEMENT POLICIES - The HeatherRidge Umbrella Association (HUA) Board will establish enforcement policies and will convene as an ad-hoc committee. 6. FIRE LANE – Any common parking area posted with approved fire lane signs. 7. GOLF AND TENNIS MANAGEMENT – Management company responsible to the HeatherRidge Community Manager for the implementation and enforcement of the Golf and Tennis Rules and Regulations. 8. HEATHERRIDGE CLUBHOUSE – The Central Recreational Facility (CRF) located at 5900 HeatherRidge Drive. 9. HEATHERRIDGE SOCIAL ACTIVITIES DIRECTOR – The Social Activities Director is responsible to the HUA Community Manager for managing the HeatherRidge Clubhouse and implementing general HUA Board rules and regulations. 10. HEATHERRIDGE COMMITTEES AND CLUBS – Any organized association or adult social group consisting of HeatherRidge residents that has been recognized and approved by the HUA Board. 11. HEATHERRIDGE PICNIC GROVE – The picnic area located between the first and second fairways of the golf course. 12. HEATHERRIDGE SECURITY – The HeatherRidge Security Department and the Community Manager are agents of the HUA Board and shall have the responsibility and authority to enforce all rules and regulations established by the HUA Board, and shall be the final authority as to use of the recreational facilities. 13. PET – Any domestic animal kept or housed in any dwelling unit. 14. PARK, PARKED, OR PARKING – The standing of the vehicle, whether occupied or not, otherwise than when temporarily and actually engaged in the loading or unloading of merchandise or passengers. 15. RECREATIONAL VEHICLES – A recreational vehicle shall include any vehicle designed for use as a temporary residence, to include motor homes, travel trailers, and for the purposes of these regulations, water craft, utility trailers and snowmobile trailers. 16. RULES AND REGULATIONS – Language set forth in the Covenants and Declarations, Resident Handbook, or other resolutions passed by the HUA Board to regulate the use of the Common Areas. HEATHERRIDGE UMBRELLA ASSOCIATION CORPORATE RESOLUTION ARTICLE 1. ESTABLISHING RULES AND REGULATIONS FOR SPEED LIMIT AND THE PARKING OF VEHICLES Section I – Speed Limit, Parking Rules and Regulations 1. General Rules and Regulations: a. Vehicle speeds on HeatherRidge streets are limited to 15 mph. b. No vehicle(s), which is unlicensed or unable to lawfully move under its own power upon the roadways of this State, shall be parked in a parking space. c. Vehicles shall be parked in such a manner so as not to block the normal flow of vehicular, or pedestrian traffic upon roadways, driveways, sidewalks, garages, or other parking spaces. d. No vehicle shall park in posted “no parking” or “restricted parking” areas. e. No vehicle shall park in posted fire lanes. f. No vehicle shall park on grass portions of the common area. g. Handicapped parking areas may only be used by person(s) who have obtained the required handicapped credentials under the provisions of the Illinois Revised Statutes, Chapter 95 ½, 11-1301.2. h. All vehicles shall bear a current State license, and be maintained in proper operating condition so as not to be a hazard or nuisance by noise, exhaust emissions or leakage of fluids. i. No repairs shall be performed on vehicle(s) on common areas except in emergencies. j. There shall be no assigned common area parking. Common area parking shall be on a first come, first served basis. k. Parking on HUA or Village of Gurnee streets is prohibited between 2:00 am and 6:00 am. l. The Security Department will enforce all parking rules and regulations. 2. Parking Rules and Regulations Pertaining to Recreational Vehicles. No recreational or utility vehicle shall be parked in any common parking area, except under the following conditions: a. Recreational vehicles may be parked in common parking areas for the purpose of loading and unloading. b. Only one (1) recreational vehicle parking permit will be issued per month, and will be valid for no more than a 48-hour period. c. Non-resident guests whose recreational vehicle is their sole means of transportation may park in common area parking for a period of two weeks. HeatherRidge Security must be notified of these vehicles, and a Recreational Vehicle Permit must be applied for and issued prior to the parking of the recreational vehicle. d. Unauthorized parking of recreational vehicles shall result in a storage fee of $20 per day, payable to the HeatherRidge Umbrella Association (HUA), and the Association shall exercise any right or remedy permitted by the HeatherRidge Umbrella Association Declaration of Covenants and By-Laws to collect such fees. e. Any recreational vehicle parked on common area without a valid parking permit shall be considered illegal and vehicles will be removed at owner's expense. Section II – Handicapped Parking Regulations 1. For the purpose of these regulations, the definition of a handicapped person as stated in the Illinois the Illinois Revised Statutes Chapter 95 ½ shall be used when determining a resident’s eligibility for a designated handicapped parking place. 2. The Security Department will investigate requests and recommend to the HUA Board if additional handicapped parking places are justified. Residents making application are required to meet the following criteria: a. The application being made is for a full-time resident of HeatherRidge who meets the definition of a handicapped person. b. A parking space is available in such proximity to the resident’s unit that posting the parking place would be more beneficial than the use of the assigned garage stall. c. The designated parking place is only valid so long as the handicap exists. If by reason of improved health, the assignee no longer meets the definition of a handicapped person, the assigned parking designation will be removed. 3. Handicapped parking places are primarily for the use of the resident making application, but may be used by any other vehicle which displays approved handicapped license plates or placards. The HUA Board will assign additional handicapped parking spaces as it deems necessary. Section III – Procedure for the Removal of Abandoned Vehicles Upon a vehicle being deemed abandoned, as set forth by these regulations, the following procedure will be followed: a. The vehicle will be tagged by the HeatherRidge Security Department, stating the date, and time the vehicle will be towed. The HUA Board reserves the right to use all legal remedies to collect citation fees. b. On the day the vehicle is tagged, a registered letter will be sent to the vehicle owner stating the intent to tow the vehicle, seven (7) days from the date the vehicle was tagged. c. At the end of the seven (7) day period, the vehicle will be towed from HeatherRidge property and the vehicle owner will be responsible for the towing and storage fees incurred. The HUA Board is absolved of any responsibility for damages or costs incurred in removing the vehicle. d. The HeatherRidge Security Department will complete a tow report and generate a case report upon the vehicle being towed, stating the date and time the vehicle was towed, and the company who towed the vehicle. The Gurnee Police Department will also be notified that the vehicle was removed by the Security Department. e. In extreme and unusual circumstances the Security Department may have the vehicle removed immediately. Procedures in paragraph d (above) should be followed. Section IV – Procedure for Parking of Vehicles, Rules and Regulations Enforcement Should a violation of the Rules and Regulations occur, the Rules and Regulations Enforcement Policy (Article 5, Section I) will be followed. HEATHERRIDGE UMBRELLA ASSOCIATION CORPORATE RESOLUTION ARTICLE 2. ESTABLISHING RULES AND REGULATIONS FOR PETS Section I – Pet Rules and Regulations 1. It is the responsibility of the pet owner to clean up after their pets immediately after the pet relieves itself. Pets will be curbed at least 30 feet from any building or residence. 2. Pets that are left outdoors unattended must be on a leash of such length that will not permit the animal to move from the patio onto common area. Unleashed animals are not allowed in any common area or recreation facility. 3. Pets being walked must be on a leash at all times and owners must maintain control of the pet(s) at all times. 4. Barking or other noises causing irritation to other residents will not be allowed. 5. Doghouses are not permitted. 6. Nothing in this resolution shall prevent the HUA from enforcement of Section 3.06 or Section 3.14 of the HeatherRidge Umbrella Association Declarations. 7. Village of Gurnee rules and regulations take precedence in animal regulations. Stray or free-roaming animals will be picked up by the appropriate Village of Gurnee animal control officials. Section II – Procedure for Pet Rules and Regulations Enforcement 1. Should a violation of these Rules and Regulations occur, the Rules and Regulations Enforcement Policies (Article 5, Section I) will be followed. 2. Any damage caused by a pet to any common area will be repaired and billed to the pet owner at a rate of $50.00 per hour, plus materials. 3. The Gurnee Village Board has approved an amendment to the Gurnee Municipal Code which applies to pet owners who walk their animal(s) outside the limits of their own property. a. It is unlawful for any person to allow their dog, cat, or other animal to be on another’s property unless they have in their possession a device to remove animal excrement. b. It is also unlawful for any person to allow their dog, cat, or other animal to be on another’s property and fail to remove excrement left by their animal. c. Anyone violating this section of the Municipal Code may be subject to a fine of not less than $50 and not more than $500 for each offense. The HUA Board reserves the right to use all legal remedies to collect these fees. In addition to fines resulting from violations of these rules, violators may be subject to Village of Gurnee municipal fines. HEATHERRIDGE UMBRELLA ASSOCIATION CORPORATE RESOLUTION ARTICLE 3. ESTABLISHING RULES AND REGULATIONS FOR THE CENTRAL RECREATIONAL FACILITY Section I – HeatherRidge Clubhouse Use The HeatherRidge Clubhouse, Picnic Grove, Golf Course and Tennis Courts are for the benefit and enjoyment of the HeatherRidge residents and such other persons as approved by the HUA Board. All users are subject to the rules and regulations set forth in the following sections. Section II – HeatherRidge Clubhouse 1. Occupancy Limit: 150 people. 2. Fee Schedule: A reservation fee schedule has been established for the use and cleanup of the facility. Reservation information and fee schedules may be obtained from the HeatherRidge Social Activities Director at (847) 680-7350. a. Private parties are open to the lessee and his/her guests only. The lessee must pay a security deposit determined by the HUA Board. The lessee must also pay rental, setup, and cleaning fees, and is subject to all rules and regulations as stated in the rental contract and rental agreements. b. Reservations for private and community parties should be made not less than ten (10) days in advance through the HeatherRidge Social Activities Director. 3. HeatherRidge Special Interest Groups. a. All activities planned by HeatherRidge committees and clubs that require the use of the HeatherRidge Clubhouse must be called into the HeatherRidge Social Activities Director to check for availability and/or for publication in the monthly HeatherRidge Happenings on the Master Calendar. b. Special Interest Groups are defined as a number of HeatherRidge residents with like interests who have formed a club or league (for example Card Clubs, Book Clubs, Golf and Tennis Leagues, Art Leagues, Conservation Club, Sewing Clubs, etc.). Special Interest Groups are permitted use of the building at no charge, but are responsible for their own set-up of any tables and chairs that they may use. Cleaning fees will be waived as long as the building is returned to its original state of cleanliness. Should the building be left in a mess, a cleaning fee of $40 will be levied against the group, and a warning issued. Should it happen again, the group’s privilege may be revoked. 4. Non-resident use. Non-resident lessees will be required to have a Security Officer present during the entire event at a charge approved by the HUA Board. Security services will be provided by the HeatherRidge Security Department. The charge for security service will be determined by the HUA Board, and must be paid in advance by the lessees. 5. The HUA carries a liquor liability insurance policy for the use of the Pro-shop and Cabana Bar, the HeatherRidge Clubhouse Waterfall Lounge and for events and activities sponsored by the same. 6. Infants, toddlers, and children are prohibited from entering the Clubhouse Waterfall Lounge room when alcohol is being served. 7. No alcoholic beverages may be brought onto HeatherRidge property for any private party. Bar service will be provided by the HeatherRidge Clubhouse upon request. However, the bartender’s wages (independent contractor) are the responsibility of the lessee. When the lessee does not require bar service, special arrangements may be made regarding non-alcoholic beverages. Please contact the HeatherRidge Social Activities Director for details. 8. An inspection of the facility will be completed by Security and/or Management before and after all private parties. Any damage to the building, furniture, or fixtures is the responsibility of, and must be paid for by the lessee. 9. When a HeatherRidge committee or club is holding a scheduled event at the HeatherRidge Clubhouse, members of the group may purchase individual drinks from the HeatherRidge Cabana Bar and the Waterfall Lounge during normal operating hours. No package goods will be sold. Section III – Picnic Grove The HeatherRidge Picnic Grove is located between the 1st and 2nd fairways of our golf course. It is available for rental by HeatherRidge residents, however, anyone who wishes to utilize or attend a function at the Picnic Grove must recognize that it is located in the middle of the Heather Ridge Golf Course and must sign a waiver of liability. 1. Reservations: Contact the HeatherRidge Social Activities Director at the HeatherRidge Clubhouse. 2. Capacity: Maximum of 100 people. 3. Hours: 7:00 am – 11:00 pm. 4. Usage Fee: A $25 fee will be charged to cover costs associated with maintaining the Picnic Grove (removal of trash, etc.), and a $250 refundable security deposit is required and made out to the HeatherRidge Clubhouse. 5. Parking and Access: Vehicles may only enter the Picnic Grove to load and unload materials and food for the picnic. Vehicles may only drive on the gravel driveways, not on the grass. One car will be allowed to park in the Picnic Grove during the event. · Parking for Picnic Grove functions is available at the following locations (a map is available): · West side of Leonard Drive, north of the Covered Bridge. · Covered Bridge Condominium lot behind 930 Taylor Drive (at the 2nd fairway). · At the CRF.
· Attendees must access the Picnic Grove by either using the service road entrance just south of the Golf Maintenance Building on Leonard Drive or by walking behind the 1st or 2nd hole golf tees. Attendees must NOT walk across the fairways when the golf course is open (sunrise to sunset every day). 6. By Village of Gurnee ordinance, bonfires are not permitted. Fires for cooking food are permitted but must be completely extinguished before users leave the Picnic Grove. 7. No liquor may be sold at the Picnic Grove. If liquor will be available at a reserved event, the authorized resident reserving the Picnic Grove must purchase an endorsement to the HUA’s liquor liability insurance policy at a cost of $60, or other such rate that may then be in effect. 8. Trash. Renters will gather, bag, and place refuse and trash in the receptacles provided in the Picnic Grove. 9. Noise and disturbance. No activities will be conducted in a manner that creates a disturbance to the residents or to the golfers. Section IV – Golf Club 1. The Golf Club is available to all residents of HeatherRidge and the general public. Management has established a fee schedule approved by the HUA Board. 2. The Golf Club will normally be open from sunrise to sunset. 3. Residents may reserve tee times up to 14 days in advance; non-residents may reserve tee times up to 7 days in advance. Cancellations of tee times must be made 24 hours in advance. Persons deciding to play 18 holes must reserve two tee times. The Golf Club Management Policy will be followed for persons who do not show up for their tee times or cancel per policy. 4. No more than four (4) players are allowed per tee time. 5. All golf outings will require a signed outing contract, with a credit card number left for a deposit. 6. The HeatherRidge Men and Women’s golf leagues with more than a 50% resident membership have priority over tee times for special events and league play. 7. All golfers are responsible for damage caused by their play on or off the golf course. 8. Only golf or tennis shoes can be worn, no metal spiked shoes are allowed on the course. 9. Walking or jogging is strictly prohibited on the course while it is open for play. 10. Dogs or other animals may not be walked on or allowed to run loose on the golf course at any time. 11. Fishing is allowed for residents holding a valid State of Illinois fishing license. Fishing may be done between the 5th men’s tee and the pump house, and along the north side of the pond on the 2nd fairway. 12. Walking is permitted (at the walker’s own risk) adjacent to the golf course outside of the out-of-bounds markers. Persons crossing the golf course to the Picnic Grove, HeatherRidge Clubhouse or designated fishing areas should cross the golf course between the tees and greens to avoid injury or slowing play. 13. Cross-country skiing is allowed under suitable conditions (frozen ground and at least six (6) inches of snow). Section V – HeatherRidge Tennis Courts 1. Residents must have their key cards available at the court during play. 2. Scheduled tournaments and special events shall take priority over individual play. 3. Residents and guests using the courts must follow the rules posted at the court entrance. · Players must sign in and reserve court time at the Golf Pro Shop prior to play. · Only tennis-type shoes are allowed on the tennis courts. · No beverages or food (with the exception of bottled water in plastic containers) are allowed in the tennis-playing area. · No glass bottles of any kind are allowed on the premises. · Due to insurance requirements and liquor license liability issues, all alcoholic beverages must be purchased from either the Cabana Bar, Pro Shop, or Waterfall Lounge. · No pets are allowed on the tennis courts. · Players shall observe tennis court courtesies. · Court time may be reserved for 1-hour periods. After 1 hour, players must yield to waiting players, regardless of the game situation. · No mechanical equipment, chairs, tables, bikes, roller blades, skateboards, etc., are allowed on the tennis court area. · All activities other than tennis are prohibited. · Residents must have their key card while on the tennis courts. Non-residents without a receipt or season pass indicating their payment of tennis court fees (see below) will be asked to leave. · HeatherRidge tennis courts close at dusk. 4. The tennis courts are available to all residents of HeatherRidge and the general public. Management has established a fee schedule approved by the HUA Board. For HeatherRidge residents there is no fee. Non-residents may purchase either a daily pass or a season pass. Section VI – HeatherRidge Key Cards 1. Use of the pools and Neighborhood Recreational Centers requires a HeatherRidge key card. These cards are available from the Security Office 24 hours a day. Cards will only be issued to new residents after they have attended a meeting of the HeatherRidge Welcoming Committee. These meetings are held periodically. To obtain a key card, you must prove residency by showing two pieces of identification from the following list: · Illinois Driver’s License · Illinois Identification Card · Current lease or closing statement · Vehicle registration or insurance card · Homeowner or renter insurance statement · Illinois Firearms Owner’s Identification Card · Current telephone bill · Commonwealth Edison electric bill · North Shore Gas bill · Voter’s Registration Card 2. A nominal fee determined by the HUA Board is required for each key card and is payable by check only. Checks must be made payable to the HUA. 3. Non-owner residents (this may include children co-habitants or permanent non-owner residents, relatives, renters, spouses) are required to post a $25 deposit for each key card requested. This deposit must be paid by a check separate from the nominal card fee, made payable to the HUA. This deposit will be refunded by mail upon return of the card to the Security Department. 4. Key cards may be issued to residential association property managers who use the Neighborhood Recreation Centers for association meetings. The issue of the key card to the residential association property manager must be approved by the neighborhood association president. 5. Key cards are also available to non-resident owners only when their tenants have not been issued cards. · HeatherRidge key cards are required as resident identification at the Neighborhood Recreation Centers, Swimming Pools, Tennis Courts, Golf Course, and the HeatherRidge Clubhouse. · Use of HeatherRidge key cards is limited to the hours of operation established by the Neighborhood Committees and the HUA Board. · It is not permitted to use a key card or identification card other than the one issued to the resident. Family members may not share key cards. During a temporary visit, residents may apply for guest privileges. (See HeatherRidge Guest Passes in Section VII.) · Keycards must be surrendered to the HeatherRidge Security Department upon demand. · Unauthorized use of key cards may result in confiscation of the card and suspension of privileges as determined by the HUA Board. · Persons found to be in violation of these rules may be subject to arrest for criminal trespass to property. Section VII – HeatherRidge Guest Passes 1. The purpose of HeatherRidge Guest Passes is to provide an opportunity for guests of HeatherRidge residents to use the recreational facilities when extenuating circumstances prevent the host resident from accompanying their guest(s). 2. Guest Passes will only be issued to guests of HeatherRidge residents to whom a validated key card has been issued. 3. Guest Passes are issued for a specific length of time. The maximum time period will not exceed two (2) weeks. The Security Department may grant an extension of one (1) week from the expiration date (on or after the date of the expiration). 4. Guests may utilize the Neighborhood Recreation Center, Swimming Pool, Tennis Courts, Golf Course and HeatherRidge Clubhouse subject to established rules set forth by the HUA. Guests may not rent the Neighborhood Recreation Centers or bring in other guests. 5. The number of Guest Passes shall be issued in accordance with the guest limits set for the Neighborhood Swimming Pool. Guest passes will not exceed four (4) passes per unit at any given time. 6. Proof of age will be required. 7. Guest Passes will be issued to guests of HeatherRidge residents over the age of 18. 8. Baby sitters may apply for an extended guest pass at the Security Department. Baby sitter passes will be limited to specific daytime hours and restricted to use only when accompanied by resident children. 9. The Security Department will issue Guest Passes. The host resident and guest must sign for the Guest Pass. 10. Guest Passes must be carried with the host resident’s validated key card. 11. The HUA Board reserves the right to restrict the use of Guest Passes, i.e., limited time of day, day of week, etc. 12. Guest passes and key cards will be revoked at the direction of the HUA Board, the Community Manager, or the Security Department if guest(s) and resident(s) do not comply with all rules set forth regarding use of the passes, key card and facilities. Section VIII – HeatherRidge Neighborhood Recreation Center Rules 1. An authorized resident may only use the Neighborhood Recreational Facility belonging to his/her respective neighborhood. An exception may be approved by the Community Manager if a Neighborhood Recreation Center is closed for repairs or renovations. 2. The Neighborhood Recreation Center may be used by authorized residents and their guests without notice, but is limited to eight persons per group. Any single gathering of more than eight persons requires a reservation, except for Homeowner Association Meetings. 3. The Neighborhood Recreation Centers are available to all authorized residents. The resident must have a valid key card issued by the HUA Security Department. Please call the Security Department for the hours of your neighborhood facility. 4. Residents wishing to use the Neighborhood Recreation Centers during the closed hours shall contact Security for access. 5. No resident or guest of a resident under the age of 18 shall use the Neighborhood Recreation Center unless he/she is accompanied by an authorized resident. 6. No pets of any kind will be allowed in any recreational facility except for service animals. 7. No games of chance played for cash, currency, or any other item of value will be permitted in any recreational facility. Section IX – HeatherRidge Neighborhood Recreation Center Party Reservation Rules 1. Neighborhood Recreation Center reservations will be made only by an authorized resident of HeatherRidge. 2. All Neighborhood Recreation Center reservations will be made by contacting the HeatherRidge Security Department. Reservations can be made 24-hours a day. 3. The Neighborhood Recreational Centers may be reserved any day of the week. Scheduled meetings of Residential Associations or Neighborhood Committees shall take precedence. 4. Reservations will be made for a period not to exceed eight hours, including cleanup. The time and duration of the reservation will be specified when the reservation in made. All functions will end after eight hours, or at 1:00 am, whichever occurs first. 5. Only one eight-hour reservation may be made per day, and only one reservation may be made per unit per month. 6. Reservations may be made eight (8) weeks or less in advance and will require a security deposit to be paid at least two weeks prior to the event. 7. A $250 security deposit made payable to the HeatherRidge Umbrella Association must be posted by the authorized resident. This check will be deposited. It shall be the intention of the HUA to refund the security deposit within 7 working days after the event. The refund check will be made payable to the authorized resident making the reservation, less any charges for cleaning or repair of damages which may have occurred. Any charges deducted from this deposit will be determined by the HeatherRidge Community Manager, who will be the final authority. 8. StoneyBrook/Cambridge Recreation Center residents pay a non-refundable $10 charge toward carpet and window cleaning. The security deposit return for StoneyBrook/Cambridge residents using the recreation center is $240. 9. Reservations for designated holidays may be submitted up to six months in advance, accompanied by a $250 security deposit. The designated holidays are: New Year’s Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day, Christmas Eve, Christmas Day, and New Year’s Eve. When competing requests for holiday reservations are submitted, award of holiday reservations shall be made by lot within seven weeks of the event. Security deposits of unsuccessful submissions shall be refundable. 10. Reservations are for the use of the upper floor of the Neighborhood Recreational Facility only. Saunas, exercise areas, and swimming pools are not available to anyone at parties. 11. The maximum number of persons allowed in the Neighborhood Recreational Centers for a reserved event is as follows: HIDDEN HILLS 75 COVERED BRIDGE 45 STONEYBROOK 75 12. The Neighborhood Recreational Center will be inventoried prior to use and again after the event by the HeatherRidge Security Department. Any damage to the building, furniture or fixtures is the responsibility of and must be paid for by the authorized resident reserving the facility. 13. The authorized resident making the reservation must be in attendance during the entire event, or designate another authorized resident to accept responsibility for the facility until the event has terminated. 14. No liquor may be sold at any of the Neighborhood Recreational Centers. If liquor will be available at a reserved event, the authorized resident reserving the facility must purchase an endorsement to the HUA’s liquor liability insurance policy at the current rate set by the HUA Board. 15. Should an event be canceled after the liquor liability endorsement has been purchased, a processing service charge of $15 will be charged and the remaining fee refunded if the policy cannot be cancelled in a timely fashion. 16. If no liquor will be available, a statement to that effect must be signed by the authorized resident. 17. No glass containers or barbeque grills will be permitted on any balcony of the Neighborhood Recreational Facilities. 18. All signs, balloons, and decorations of any type posted on the HUA property which direct guests to the event must be removed at the termination of the event. All items not removed will be removed by the HeatherRidge Maintenance or Security Department and the cost will be billed to the authorized resident. 19. No loose balloons will be allowed in the neighborhood recreation centers as they can become entangled in the ceiling fan mechanism and stuck in the atrium area. A charge of $75.00 will be levied and deducted from the security deposit if balloons, string, and/or ribbon must be removed from the ceiling fans, lights, or atriums. Section X – HeatherRidge Neighborhood Recreation Center Pool Rules The rules and regulations established for the HeatherRidge pools are based on the Minimum Sanitary Requirements for the Design and Operation of Swimming Pools and Bathing Beaches, as published by the Illinois Department of Public Health. 1. HeatherRidge pools are restricted to authorized residents possessing valid key cards, their children under 18 years of age and their guests. Children under 18 years of age and all guests shall not enter the pool area unless accompanied by an authorized resident unless a Guest Pass has been obtained. 2. All residents entering the pool area must be prepared to show a HeatherRidge Key Card to the Security Officer on duty, as they make periodic identification checks. The use of the pool facilities implies you consent to present this identification when asked. 3. The pool will be open daily from 9:00 am to 10:00 pm, if pool cleaning has been completed. 4. The pool may be closed at any time due to breakdown, weather, or other operational difficulties, and/or at the discretion of the HUA Board or the Community Manager. 5. Use of pools by guests will be limited to four guests per dwelling unit on Saturday and Sunday and six guests per dwelling unit on Monday through Friday. 6. Only persons dressed in clean swimwear shall be permitted in the pool. Cut-offs or tennis shorts are not acceptable swimwear. Toddlers and infants must wear specially designed swim diapers under swimwear. 7. No person will enter the pool area or swim alone. All persons will shower in the nude, before entering the pools as required by State Regulations. Additional showers are required after the use of sun tan lotion, and upon re-entry after leaving the pool area. 8. Only children age five and under, while supervised, are permitted in the StoneyBrook/ Cambridge wading pool. 9. Admission to the pool is refused to all persons having any contagious disease, infectious conditions such as colds, fever, ringworm, foot infections, skin lesions, carbuncles, boils, inflamed eyes, ear discharges, or any other condition which has the appearance of being infectious. Persons with excessive sunburn, abrasions which have not healed, corn plasters, bunion pads, adhesive tape, rubber bandages, or other bandages of any kind are not to be permitted in the pool area. A person under the influence of alcohol or exhibiting erratic behavior shall not be permitted in the pool area. 10. Diving is not permitted. No running, pushing or roughhousing. 11. Greaseless suntan lotion shall be used rather than suntan oils. 12. Any play equipment or floating apparatus shall not be allowed to interfere with other swimmers. No water balloons are permitted. 13. No abusive or profane language or excessive noise will be tolerated. Radios are permitted if operated on a low volume and are not objectionable to other persons. 14. Papers, cigarettes, cigars or refuse must be deposited in receptacles provided. 15. Expectorating or blowing of the nose in the pool is prohibited. 16. Wheeled vehicles, with the exception of wheelchairs and strollers, are not allowed in the pool area. 17. No food, drink, gum or tobacco will be allowed in other than specially designated and controlled sections of the pool area (see posted signs). No glassware shall be permitted in the enclosed pool area. 18. No pets will be allowed at any time on recreational facility/pool premises or tied to the fence surrounding the pool premises. 19. No wet swimwear is allowed inside the recreation center with the exception of the restrooms. 20. No fence climbing is permitted. 21. Failure to comply with any of the above rules and regulations may result in violators losing their pool privileges. 22. The cost of any property damage will be charged to the person or persons who are found responsible. 23. The pool area shall not be reserved except by special permission from the Neighborhood Committee for community-wide events sponsored by and established by the HUA Board. 24. The HeatherRidge Security Department is at all times an agent of the HUA Board, and is authorized to enforce the rules regarding the use of the swimming pools. 25. Please report any malfunction of the pools to the Security Department. HEATHERRIDGE UMBRELLA ASSOCIATION 2. This also applies to any trees or shrubs you propose to plant around your unit on common area. Please remember that any bedding plants planted by a resident in the 18” space next to the foundation are the resident’s responsibility to maintain and to remove at the end of the growing season. These plants do not require approval. Any landscape changes to the common ground require approval of the Landscape Department Head. Any unapproved or unmaintained plant material will be removed at the sole discretion of the Landscape Department. 3. For more detailed information, consult the Landscape Policy, which is available at the HUA office. Section II – HeatherRidge Neighborhood Toy Vehicle Rules No person on skates, coaster sleds, skateboards or other toy vehicles shall be allowed on any roadway, sidewalk, parking area or any other HeatherRidge Common area. Section III – HeatherRidge Signage Information and Rules 1. Residents are prohibited from posting “Sale” signs on the common areas of HeatherRidge. This includes signs advertising real estate, vehicles, garage sales and the like. The HeatherRidge Declarations state: 3.12 COMMON AREA RESTRICTIONS: No industry, business, trade occupation or profession of any kind shall be conducted, maintained or permitted on any part of the Common Area or any Neighborhood Facility nor shall any “For Sale” or “For Rent” signs or any other advertising be maintained or permitted on any part thereof, except as permitted by the HUA Board. 2. Real estate signs are permitted in the single-family neighborhood on the lawn of the residence for sale only. Signs which direct persons to the unit for sale may not be posted in the commons areas. 3. All permanent signage on HUA property must have HUA Board approval prior to placement for form, function, and location. Section IV – HeatherRidge Neighborhood Garage Sale Information and Rules Section IV – HeatherRidge Garage Sale Information and Rules (Supersedes the June 2007 HeatherRidge Neighborhood Garage Sale Information and Rules) 1. Effective January 1, 2009, the HeatherRidge community, as a whole, shall be entitled to partake in a community-wide garage sale, to be held twice a year on dates determined by the HUA. The times/dates shall be known to the Residential Associations and the Security Department a minimum of one month in advance of the scheduled date(s), and shall be listed as such in the HeatherRidge Happenings newsletter and/or on the HeatherRidge web site. 2. A permit for garage sales shall be obtained by the HUA from the Village of Gurnee. There is no charge for the permit and a copy of the permit is to be provided to the Security Department. 3. No streets will be allowed to be blocked off. 4. The HUA shall determine signage and placement policies. 5. Village of Gurnee ordinances take precedence, especially in matters relating to signage and number of garage sales permitted. The information below in "double-strikeout/underlined" has been rescinded and replaced by the five items directly above. This change was passed at the September 23, 2008 HUA Board meeting and published in the HeatherRidge Happenings for the mandatory review period. Dates for the 2009 Garage Sales will be agreed upon at the January 27, 2009 HUA Board meeting. Residential Association Garage Sales. Each Residential Association within HeatherRidge will be allowed to hold up to two association-wide garage sales within its community during a calendar year under the following conditions and regulations: 1. Each garage sale must be sponsored by the Residential Association and approved by a vote of its Board of Directors. Each association may sponsor up to two (2) sales per year.
3. The garage sales will be held on Thursday, Friday, and Saturday.
5. No streets will be allowed to be blocked off. 6. Exceptions to the HUA rules with respect to signs will be allowed as follows:
Section V – HeatherRidge Neighborhood Dumpster Usage and Disposal of Appliances, Furniture, and Construction Materials or Refuse 1. Outside contractors may not use neighborhood dumpsters, they must supply and pay for their own waste disposal. 2. Residential neighborhood dumpsters are for household trash and garbage only, not for household appliances, furniture, or construction debris. Residents are responsible for proper disposal and removal of such items. Dumpsters for large items are available on the east side of the Security Building. These dumpsters are exclusively for the use of HeatherRidge residents. Pickup service is not available and residents must transport their own items to the dumpster by the Security Building. Violators may be subject to fines. Section VI – Hours of Operation Available to Contractors HeatherRidge conforms to the Village of Gurnee ordinance on the hours contractors may work in our neighborhoods. The hours are from 7 am to 7 pm Monday through Saturday, and 9 am to 5 pm on Sundays.
1. Upon the first violation, a written warning citation will be issued by the Security Department stating the date, time and nature of the violation. A record of this warning will be maintained by the Security Department. 2. Upon a second violation of the same offense within one year, a citation will be issued by the Security Department stating the date, time and nature of the offense and a $20 fine will be levied in addition to any costs incurred to remedy the situation. Failure to pay this fine within 15 days of the date of the offense will result in a late fee being assessed in addition to the original fine. 3. Third and subsequent violations, regardless of time, will result in a citation being issued by the Security Department, again stating the date, time and nature of the offense and a $40 fine will be levied in addition to any costs incurred to remedy the situation. Failure to pay this fine within 15 days of the date of the offense will result in $25 late fee being assessed in addition to the original fine. This citation will be sent to the offender via certified mail. 4. Damage and subsequent repairs caused to common area by a violation of the Rules and Regulations shall be billed to the resident at $50 per hour plus materials. 5. The HUA shall use whatever legal means necessary to collect incurred fines and fees. Section II – Remedies If a resident feels that he/she has been wrongfully or unjustly cited for a violation, the following procedure may be followed: 1. Within 15 days of the citation, the resident may submit a written protest to the HUA Board, in care of the Community Manager, stating the reasons the individual feels the citation is unjust. The HUA Board will then forward the protest to the appropriate committee chairperson. 2. Should no protest be filed, the allegations in the citation shall be considered true. Should a protest be filed within the prescribed time, a hearing on the matter shall be held with the appropriate committee no later than six (6) weeks after the receipt of the written protest. 3. At the hearing, the responsible committee shall hear and consider arguments, evidence or statements regarding the alleged violation. After a full hearing, the responsible committee shall state its findings regarding the alleged violation. 4. Payment of charges or late fees levied under this policy shall not become due and/or owing until the responsible committee has returned its findings. However, other legal or equitable remedies may be pursued by the HUA Board during this time. The responsible committee will make its findings known to the Community Manager and either the Landscape or Security Departments as is appropriate.
